1. PARTIES
This Room Rental Agreement (“Agreement”) is made this ___ day of _____, 20__, between _______ (“Landlord”) and _______ (“Tenant”).
2. PREMISES
The premises are located at _______, Nebraska. The premises consist of one bedroom, a shared bathroom, and shared common areas.
3. TERM
The term of this Agreement shall commence on _____ and shall continue until ______. This Agreement may be extended by mutual agreement between the parties.
4. RENT
The monthly rent for the premises is $_____, payable on the first day of each calendar month. The first month’s rent is due and payable upon Tenant’s signing of this Agreement.
5. SECURITY DEPOSIT
Upon the execution of this Agreement, Tenant will deposit with Landlord the sum of $_____ as security for the performance by Tenant of the terms under this Agreement and for any damages caused by Tenant, Tenant’s family, agents and visitors to the premises during the term of this Agreement. Nebraska law (Neb. Rev. Stat. § 76-1416) states that this deposit cannot be more than one month’s rent unless special conditions pose a danger to maintenance of the premises.
6. USE OF PREMISES
The premises shall be used as a private dwelling for the Tenant only. The Tenant will comply with all laws and rules affecting the premises.
7. REPAIR AND MAINTENANCE
Tenant will keep the premises in clean, sanitary, and good condition. Any damage to the premises will be repaired at the Tenant’s expense.
8. INSURANCE
Tenant is responsible for having sufficient insurance to cover all personal property located on the premises. Landlord will not be responsible for any damage to Tenant’s personal property.
9. DEFAULT
If Tenant fails to comply with any of the material provisions of this Agreement, or of any present rules and regulations, Landlord may terminate this Agreement upon providing proper notice to Tenant.
10. TERMINATION
Upon termination of this Agreement, Tenant will return the premises and all property of Landlord in a clean and good condition.
11. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the state of Nebraska.
12. ENTIRE AGREEMENT
This Agreement contains the entire agreement between Landlord and Tenant and cannot be changed except by written agreement.
13. WAIVER
Landlord’s acceptance of rent does not waiver Landlord’s rights to enforce this Agreement.
