THIS OCCUPANCY AGREEMENT
(“Agreement”) is made and entered into this _______ day of ___________, 20___, by and between _________________ (hereinafter “Owner”) and _________________ (hereinafter “Occupant”).
1. PREMISES
Owner rents to Occupant and Occupant hires from Owner the premises located at _________________, together with any personal property located thereon (collectively, the “Premises”). The Premises will be used for residential purposes only.
2. TERM
The initial term of this Agreement will begin on _________________ and will end on _________________. Thereafter, the Agreement will continue on a month-to-month basis until either Owner or Occupant terminate this Agreement with 30 days’ notice.
3. RENT
Occupant shall pay to Owner the monthly rent of $_______, payable on the first day of each calendar month.
4. SECURITY DEPOSIT
Upon execution of this Agreement, Occupant will deposit with Owner the sum of $_______ as security for Occupant’s faithful performance of Occupant’s obligations under this Agreement.
5. USE OF PREMISES
The Premises shall be used and occupied by Occupant exclusively as a private single family dwelling, and no part of the Premises shall be used at any time during the term of this Agreement by Occupant for the purpose of carrying on any business, profession, or trade of any kind, or for any purpose other than as a private single family dwelling.
6. REPAIR AND MAINTENANCE
Occupant will keep the Premises in clean, sanitary, and good condition. If Occupant fails to comply with this requirement, Owner can perform the necessary cleaning and/or repair and charge the Occupant for the cost of such work.
7. INSURANCE
Occupant is responsible for having sufficient insurance to cover all personal property located on the Premises. Owner will not be responsible for any loss of Occupant’s personal property.
8. PETS
No pets will be allowed on the Premises without the prior written consent of Owner.
9. DEFAULT
If Occupant fails to comply with any of the material provisions of this Agreement, or of any present rules and regulations governing the Premises, Owner may terminate this Agreement upon providing proper notice to Occupant.
10. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the state of Wyoming.
11. ENTIRE AGREEMENT
This Agreement contains the entire agreement of the parties and there are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this Agreement.
12. AMENDMENTS
This Agreement may be modified or amended in writing, if the writing is signed by the party obligated under the amendment.
13. WAIVER
The failure of either party to enforce any provisions of this agreement shall not be construed as a waiver or limitation of that party’s right to subsequently enforce and compel strict compliance with every provision of this agreement.
