OCCUPANCY AGREEMENTThis Occupancy Agreement (hereinafter referred to as the “Agreement”) made on this ______ day of ________, 20_____ (the “Effective Date”) by and between _____________________ (hereinafter referred to as the “Landlord”) with a principal address located at ______________________ and ______________________ (hereinafter referred to as the “Occupant”) with a principal address located at ______________________.
PREMISESThe Landlord rents to the Occupant and the Occupant rents from the Landlord, the premises located at _____________________. The premises will be used for residential purposes only.
TERMThe term of this Agreement will begin on ______________________ and will end on ______________________. After the end of the Term, this Agreement will continue on a month-to-month basis until either the Landlord or the Occupant terminate this Agreement by giving a written notice.
RENTThe monthly rent for the premises is _______________ payable on first day of each calendar month.
SECURITY DEPOSITUpon the execution of this Agreement, Occupant will deposit with Landlord the sum of __________ as security for any damage caused to the Premises during the term hereof.
USE OF PREMISESThe Premises shall be used for residential purposes only. The Occupant will comply with all laws and rules affecting the Premises.
REPAIR AND MAINTENANCEOccupant will keep the Premises in clean, sanitary, and good condition. The Occupant will notify the Landlord promptly of any damage to the Premises.
INSURANCEOccupant will have sufficient insurance to cover all personal property located on the Premises. Landlord will not be responsible for any loss of Occupant’s property.
DEFAULTIf Occupant fails to comply with any of the material provisions of this Agreement, or of any present rules and regulations governing the Premises, Landlord may terminate this Agreement upon providing proper notice to Occupant.
GOVERNING LAWThis Agreement is governed by and construed in accordance with the laws of the State of Tennessee.
ENTIRE AGREEMENTThis Agreement contains the complete agreement between Landlord and Occupant and cannot be changed except by written agreement.

TENNESSEE SPECIFIC PROVISIONSThe following are additional provisions that are specific to the State of Tennessee:
DISCLOSURE OF LEAD-BASED PAINTFor any rental property built before 1978, Landlord must disclose the presence of known lead-based paint and lead-based paint hazards in the dwelling before the lessee is obligated under any lease to rent the dwelling.
REPAIRS AND MAINTENANCEIn Tennessee, landlords must comply with applicable building and housing codes materially affecting health and safety and make all repairs and do whatever is necessary to put and keep the premises in a fit and habitable condition. ______________________ Landlord ______________________ Occupant
