OCCUPANCY AGREEMENT

THIS AGREEMENT is made and entered into this ______ day of ___________, 20_____, by and between _________________(hereinafter “Landlord”), and _________________(hereinafter “Occupant(s)”).

PROPERTY:

Landlord rents to Occupant and Occupant rents from Landlord, for residential purposes only, the premises located at the following address: ________________. The premises will be used for residential purposes only.

TERM:

The initial term of this Agreement will begin on ____________, and will continue until ____________. Thereafter, the Agreement will continue on a month-to-month basis until either Landlord or Occupant terminate this Agreement with written notice.

RENT:

Occupant agrees to pay $__________ per month, due on the 1st day of each calendar month.

SECURITY DEPOSIT:

Upon execution of this Agreement, Occupant will deposit with Landlord the sum of $__________ as security for the performance by Occupant of the terms under this Agreement and for any damages caused by Occupant, his/her agents, employees or guests. In accordance with California state law, Landlord may withhold from the security deposit only such amounts as are reasonably necessary for the following purposes: to remedy Occupant defaults, to repair damages to the premises caused by Occupant, and to clean the premises upon termination of the tenancy.

USE OF PREMISES:

The premises shall be used for residential purposes only. The premises shall not be used to carry on any type of business or trade without prior written consent of the Landlord.

OCCUPANTS:

No persons other than those specified in this agreement shall occupy the premises without prior written consent from the Landlord. The persons specified in this Agreement are: ____________.

REPAIR AND MAINTENANCE:

Occupant will keep the premises in clean, sanitary, and good condition. If any damage is done to the premises or the contents of the premises, Occupant will pay for the repairs or replacement needed.

INSURANCE:

Occupant is responsible for having sufficient insurance to cover all personal property located on the premises.

DEFAULT:

If Occupant fails to comply with any of the material provisions of this Agreement, or of any present rules and regulations governing the premises, Landlord may terminate this Agreement upon providing proper notice to Occupant.

QUIET ENJOYMENT:

Occupant shall conduct himself, and require other persons who are on the premises with Occupant’s permission, to conduct themselves in a manner that will not disturb others’ peaceful enjoyment of the premises.

TERMINATION UPON SALE OF PREMISES:

Notwithstanding any other provision of this Agreement, Landlord may terminate this agreement upon 30 days’ written notice to Occupant if the premises are sold.

This agreement is binding upon and inures to the benefit of the Parties and their respective heirs, executors, administrators, successors and assigns.

NOTICE: Pursuant to California Civil Code Section 1950.5(b), Lessor may claim of the security deposit only such amounts as are reasonably necessary to remedy tenant defaults in the payment of rent, to repair damages to the premises exclusive of ordinary wear and tear, to clean the premises upon termination of the tenancy, or to compensate for any other breach of this lease agreement.
