1. PARTIES AND PREMISES

This Occupancy Agreement (the “Agreement”) is entered into on this ________ (Date) ________, between ________ (Landlord’s Name) ________, of ________ (Landlord’s Address) ________ , hereinafter referred to as the “Landlord”, and ________ (Tenant’s Name) ________, of ________ (Tenant’s Address) ________, hereinafter referred to as the “Tenant”.

The Landlord rents to the Tenant and the Tenant rents from the Landlord, the premises located at ________ (Property Address) ________. The premises will be used for residential purposes only.

2. TERM OF THE AGREEMENT

The term of this Agreement will start on ________ (Start Date) ________ and will continue until ________ (End Date) ________. Upon termination of the Agreement, Tenant will return the premises and all property of Landlord in a clean and good condition.

3. RENT

Tenant agrees to pay $________ (Rent amount) ________ per month, due on the 1st day of each calendar month. If the Lease begins after the 1st day of the month, the first month’s rent will be prorated.

4. SECURITY DEPOSIT

Upon execution of this Agreement, Tenant will deposit with Landlord the sum of $________ (Security Deposit) ________ as security for compliance with the terms of this Agreement.

5. REPAIR AND MAINTENANCE

Tenant will keep the premises in clean, sanitary, and good condition. If any damage to the premises is caused by Tenant or Tenant’s guests, Tenant will notify Landlord, and Landlord will have the right to repair such damage, and Tenant will be responsible for any reasonable repair costs.

6. INSURANCE

Tenant is responsible for having sufficient insurance to cover all personal property located on the Property. Landlord will not be responsible for any loss of Tenant’s property, whether by theft, fire, acts of God, or otherwise.

7. DEFAULT

If Tenant fails to comply with any of the material provisions of this Agreement, Landlord may terminate this Agreement upon providing proper notice to Tenant.

8. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Arkansas.

9. ENTIRE AGREEMENT

This Agreement contains the entire agreement of the parties and there are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this Agreement.

10. AMENDMENT

This Agreement may be modified or amended in writing by mutual agreement between the parties.
