CONTRACT FOR DEED
This Contract for Deed (“Agreement”) is made this
____ day of _______, 20____ (the “Effective Date”), by and between
______________ (“Seller”) and
______________ (“Buyer”).
1. PROPERTY
Seller agrees to sell and Buyer agrees to buy the property located at
______________, being more fully described as:
______________ (“Property”).
2. PURCHASE PRICE
The total purchase price for the Property is
$________.
3. PAYMENT TERMS
The Buyer shall pay the total purchase price to Seller at
______________ by certified check, bank money order, wire transfer, or as otherwise agreed upon by both parties.
4. DEED AND TITLE
Upon execution of this Agreement and payment of the total purchase price, Seller shall deliver to Buyer a duly executed and acknowledged warranty deed, conveying the Property to Buyer, subject to the terms and conditions of this Agreement.
5. POSSESSION AND OCCUPANCY
Possession and occupancy of the Property shall be delivered to Buyer on the date of closing.
6. TAXES AND ASSESSMENTS
All property taxes shall be prorated as of the date of closing.
7. REPRESENTATIONS AND WARRANTIES
Seller represents and warrants to Buyer that the Property is free and clear of all liens and encumbrances, except those noted in this Agreement.
8. DEFAULT
If Buyer fails to comply with any term or condition of this Agreement, Seller may terminate this Agreement upon providing written notice to Buyer.
9. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of New Hampshire.
10. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions, negotiations, and agreements, whether oral or written.
