COMMERCIAL LEASE AGREEMENT
THIS AGREEMENT made and entered into this ____ day of _____, 20____, by and between ____________________ (hereinafter “Landlord”) and ____________________ (hereinafter “Tenant”).
1. PREMISES
Landlord hereby leases to Tenant and Tenant rents from Landlord the premises located at ______________. The premises will be used for ______________. The term of this Lease will start on ______________ and will end on ______________.
2. RENT
Tenant agrees to pay Landlord as base rent the sum of $_____ per month, due and payable monthly in advance on the first day of each calendar month.
3. SECURITY DEPOSIT
Upon the execution of this Agreement, Tenant will deposit with Landlord the sum of $______ as security for Tenant’s faithful performance of Tenant’s obligations under this Agreement.
4. REPAIR AND MAINTENANCE
Tenant will, at its sole cost and expense, keep and maintain the Premises and appurtenances in good and sanitary condition and repair.
5. INSURANCE
Tenant will maintain a policy of comprehensive general liability insurance with limits of liability of not less than $______ per occurrence.
6. COMPLIANCE WITH LAW
Tenant shall comply with all the laws, orders, and regulations of federal, state, county, and municipal authorities, and agrees to hold Landlord harmless from penalties, fines, costs, and damages which it may sustain by reason of Tenant’s failure to comply with the same.
7. ASSIGNMENT AND SUBLETTING
Tenant shall not assign this Agreement, or sublet or grant any concession or license to use the Premises or any part thereof without the prior written consent of Landlord.
8. DEFAULT
If Tenant fails to comply with any of the material provisions of this Agreement, or of any present rules and regulations governing the Premises, Landlord may terminate this Agreement upon providing proper notice to Tenant.
9. QUIET ENJOYMENT
Tenant shall conduct its business and control its agents, employees, invitees and visitors in such a manner as not to create any nuisance, or interfere with, annoy or disturb any other tenant or Landlord in its management of the Building.
10. INDEMNIFICATION
Tenant will indemnify, hold harmless, and defend Landlord from and against any and all losses, claims, liabilities, and expenses, including reasonable attorney fees, if any, which Landlord may suffer or incur in connection with Tenant’s possession, use or misuse of the Premises.
11. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of South Carolina.
