Anatomical Gift Donation Agreement
This Anatomical Gift Donation Agreement (hereinafter referred to as the “Agreement”) is entered into on this ____ day of _____, 20____, by and between _____(Name of Donor)______ (hereinafter referred to as the “Donor”) and _____(Name of Recipient Organization)______ (hereinafter referred to as the “Recipient”).
1. Declaration of Intent
The Donor, of sound mind and not under any duress, undue influence, or constraint, hereby voluntarily gives, donates, and bequeaths to the Recipient, his/her body and/or specified organs, to be used for medical research, education, advancement of medical, dental, and health sciences, and any other lawful purpose, upon his/her death.
2. Specific Organ/Tissue Donations
The Donor specifies the donation of the following organ(s) and/or tissue(s): ______ (Specify Organ/Tissue)______. The Donor understands and acknowledges that the actual donation of specific organs and tissues will depend on the Donor’s medical condition at the time of death and the decision of medical professionals.
3. Revocation of Donation
The Donor reserves the right to revoke this Agreement at any time by providing written notice of revocation to the Recipient. Upon receipt of such notice, the Recipient will cease all actions related to the procurement of the Donor’s body or specified organs/tissues.
4. Use of Donated Body or Organs
The Donor expressly permits the Recipient to use the donated body or organs for medical education, research, advancement of medical, dental, and health sciences, or any other lawful purpose, including transplantation, therapy, research, or education.
5. Disposition of Remains
Upon completion of the use of the donated body or organs for the above-stated purposes, the Recipient shall provide for the final disposition of the Donor’s remains in accordance with applicable laws and regulations. The Recipient may, at its discretion, return the remains to the family for final disposition, or may arrange for cremation and scattering or interment of the remains.
6. Release of Liability
The Donor hereby releases and holds harmless the Recipient, its employees, agents, and affiliates, from any and all claims, liabilities, damages, and expenses, including attorney’s fees, arising out of any act or omission in the implementation of this Agreement, except for willful misconduct or gross negligence.
7. Governing Law
This Agreement shall be governed by and construed under the laws of the state of ______(Name of State)______.
